Tax Probe of Bakrie’s KPC May Continue, Court Rules

The Supreme Court said on Monday that the Finance Ministry’s Directorate General of Taxation could continue its probe into PT Kaltim Prima Coal, which is alleged to have evaded Rp 1.5 trillion ($163.5 million) of taxes.

Last week, the Supreme Court upheld a December 2009 ruling by the Tax Tribunal, which found the tax office did not have sufficient evidence to upgrade its probe of KPC, a subsidiary of the Bakrie group’s PT Bumi Resources, to a full investigation.

Supreme Court spokesman Hatta Ali said that last week’s decision focused on the administrative procedures of the probe and not the allegations. “The tax office could still fix its error and continue its probe on the tax evasion allegation.”
